We provide our service "as is" — we work hard to make it accurate, but accessibility compliance is ultimately your responsibility, and we are not your lawyer.
01Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of adacompliantsite.com and any related products or services (the "Service"), operated by AI On Call Solutions LLC ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
02Description of service
We provide automated and manual accessibility scanning of websites against the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA, along with related remediation guidance, monitoring, and compliance reporting. Our service is intended to help website operators identify and address accessibility barriers, but does not constitute legal advice or a guarantee of compliance with the Americans with Disabilities Act (ADA) or any other law.
03Your account
To access certain features, you must register an account. You agree to:
- Provide accurate, current, and complete information;
- Maintain the security of your password and accept all risks of unauthorized access;
- Notify us immediately of any breach of security or unauthorized use of your account;
- Be responsible for all activity that occurs under your account.
You must be at least 18 years old and authorized to bind any business entity you represent.
04Fees & billing
Paid plans
Paid plans are billed in advance on a monthly or annual basis. By signing up for a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel. Fees are non-refundable except as expressly stated in these Terms or required by law.
Free scans
We offer free single-URL accessibility scans without obligation. Free scans are limited in scope and frequency at our discretion.
Cancellation
You may cancel your subscription at any time through your account dashboard or by emailing us. Cancellation takes effect at the end of your current billing period; you retain access until then. We do not pro-rate refunds for partial billing periods.
Price changes
We may change prices for paid plans with 30 days' notice. Continued use after a price change constitutes acceptance.
05Scans & authorization
By submitting a URL for scanning, you represent and warrant that:
- You own the website, or you are authorized by the owner to request a scan;
- The scan will not violate any law, contract, or third-party right;
- You will not use our Service to test sites without proper authorization.
Our scanners crawl publicly accessible pages and follow standard robots.txt conventions. For authenticated or non-public pages, you must provide explicit written authorization and any necessary credentials.
06Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from our Service;
- Use the Service to scan, monitor, or attack any website you do not own or have permission to test;
- Resell, sublicense, or commercially redistribute our reports or scan data without our written consent;
- Use the Service in any way that could damage, disable, overburden, or impair our infrastructure;
- Use the Service to violate any applicable law or regulation;
- Submit false, misleading, or fraudulent information.
07Intellectual property
All content, software, designs, trademarks, and other materials available through the Service are the property of AI On Call Solutions LLC or our licensors and are protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of any content you submit to us, but grant us a worldwide, royalty-free license to use it for the purpose of providing the Service.
08Third-party services
The Service may integrate with third-party tools (e.g., payment processors, hosting providers, analytics). We are not responsible for the practices or content of third parties. Your use of any third-party service is governed by that third party's terms and policies.
09Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service.
We do not warrant that our scans will identify every accessibility violation on your site, that following our guidance will guarantee compliance with the ADA or any other law, or that you will not be the target of an accessibility-related lawsuit. We are an accessibility-testing service, not a law firm. For legal advice, consult a qualified attorney.
10Limitation of liability
To the maximum extent permitted by law, AI On Call Solutions LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) $100.
11Indemnification
You agree to indemnify, defend, and hold harmless AI On Call Solutions LLC and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your unauthorized scanning of websites.
12Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.
13Governing law & disputes
These Terms are governed by the laws of the United States and the state in which AI On Call Solutions LLC is organized, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts of that state, and you consent to personal jurisdiction in those courts.
Class action waiver. You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.
14Changes to these terms
We may modify these Terms at any time. We will post the revised version on this page and update the "Last updated" date. For material changes, we will give you reasonable advance notice by email or in-app notice. Your continued use of the Service after the change becomes effective constitutes acceptance of the revised Terms.
